Terms of Service

These Terms of Service ("Terms") govern your use of the website at www.detailingproducts.co.nz (the "Site") and the purchase of physical products from The Excellence Group Limited trading as Specialist Detailing Products ("Company," "we," "us," or "our").

By accessing or using the Site, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing this Site.


 

1. General Terms and Governing Law

1.1 Parties and Acceptance: The Excellence Group Limited t/a Specialist Detailing Products, a company registered in New Zealand, operates this Site. Your use of the Site constitutes your legally binding agreement to these Terms.

1.2 Governing Law: These Terms are governed by and construed in accordance with the laws of New Zealand. We operate in compliance with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

1.3 Privacy Policy: These Terms incorporate our Privacy Policy, available at: https://www.detailingproducts.co.nz/policies/privacy-policy.

1.4 Dispute Resolution: Any dispute must first be brought to the Company's attention in writing. We are committed to an internal process for resolution and expect good faith efforts from the customer to resolve the matter directly before pursuing external legal action.

2. Products, Pricing, and Ordering

2.1 Product Description: We sell physical detailing products. While we attempt to be as accurate as possible in product descriptions, colors, and features, we do not warrant that all product descriptions are completely accurate, complete, reliable, current, or error-free.

2.2 Pricing and Tax: All prices displayed on the Site are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST). We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice (including after you have submitted your order).

2.3 Payment: We accept payment via Visa, Mastercard, and American Express. You warrant that you are legally entitled to use the payment method provided for your purchase.

2.4 Order Acceptance and Inventory: Receiving an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to accept or reject your order for any reason. We may, at times, accept backorders, which will be clearly indicated. Fulfillment of backorders is dependent on manufacturer supply and is subject to delay.

2.5 Order Cancellation/Modification: Orders can only be cancelled or modified where required under the Consumer Guarantees Act (e.g., if a product is faulty) or with our prior written permission within 24 hours of order placement.

3. Shipping and Risk of Loss

3.1 Shipping Region: We currently do not ship overseas. Our sales are limited to customers within New Zealand.

3.2 Risk of Loss: The risk of loss or damage to items purchased from the Site remains with us until the moment the product is shown as delivered according to the freight carrier's tracking and delivery system.

4. Returns, Refunds, and Consumer Guarantees

4.1 Consumer Guarantees: Nothing in these Terms is intended to exclude, restrict, or modify a customer’s rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

4.2 Right to Return (Non-Faulty Goods): We generally do not offer returns or refunds for "change of mind." Returns are accepted only if a product is defective, faulty, or otherwise covered by a non-excludable consumer guarantee. Any exception to this (e.g., voluntary return within 24 hours) must be explicitly approved by us in writing.

4.3 Return Condition: All returned items (unless defective) must be in their original, unused condition. We reserve the right to reject returns that do not meet this standard.

4.4 Return Shipping:

  • If the product is defective, faulty, or incorrectly sent, we will cover the cost of return shipping.

  • If a return is agreed upon for a change of mind (or other reason not covered by the CGA), the customer is responsible for all return shipping costs.

4.5 Non-Returnable Items: Gift cards are considered final sale and cannot be returned, exchanged, or refunded.

5. User Accounts and Conduct

5.1 Account Requirement: You must create an account on the Site or use a verified third-party service (such as Shop Pay) to complete a purchase. You are responsible for maintaining the confidentiality of your account details.

5.2 Minimum Age: There is no minimum age requirement to use the Site. However, by purchasing, you warrant that you are legally entitled to use the payment method provided.

5.3 User-Generated Content (UGC): We permit user-generated content (UGC), such as product reviews and comments. By posting UGC, you grant Specialist Detailing Products a perpetual, irrevocable, worldwide, royalty-free, and sub-licensable license to use, reproduce, modify, publish, and display the content for any business purpose, including marketing and promotion.

5.4 Termination: We reserve the right to suspend or terminate your account and access to the Site for any violation of these Terms, including but not limited to fraudulent activity, spamming, harassment, or abuse of the Site or our staff.

6. Intellectual Property

6.1 Our Intellectual Property (IP): All content on the Site, including text, graphics, logos, images, product photos, and design, is the property of The Excellence Group Limited t/a Specialist Detailing Products and is protected by New Zealand and international copyright laws. Specialist Detailing Products is a trademark of The Excellence Group Limited.

6.2 Third-Party IP: We display logos of third-party payment processors (e.g., Visa, Mastercard), which are the property of their respective owners. We are authorized to display these logos for transaction purposes.

6.3 Permitted Linking: We generally allow others to link to our homepage, provided the link is not malicious, misleading, or does not falsely imply sponsorship, endorsement, or affiliation with us. We reserve the right to demand the removal of any link that, in our sole discretion, is deemed inappropriate.

7. Limitation of Liability and Disclaimer

7.1 General Disclaimer: The Site and all products are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, or materials included therein, except as specifically required by the Consumer Guarantees Act 1993.

7.2 Limitation: To the fullest extent permitted by New Zealand law, our total liability to you for any claim arising out of these Terms or your use of the Site shall be limited to the price you paid for the product(s) in question. This limitation does not exclude or limit liability for death or personal injury caused by our negligence, or for fraud.

7.3 Indemnification: You agree to indemnify, defend, and hold harmless Specialist Detailing Products and its employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
